Chapter One: Introduction
1.1 Background of the Study
Customary law refers to the traditional laws and practices that govern the lives of people in Nigeria’s various ethnic communities, and it often operates alongside constitutional law in many parts of the country (Bashir & Tukur, 2023). In Birnin Kebbi LGA, Kebbi State, customary law plays a significant role in regulating matters such as marriage, inheritance, and land ownership, often with little regard for the constitutional provisions that protect individual rights (Abubakar & Idris, 2024). This study aims to explore the relationship between constitutional law and customary law in Birnin Kebbi, examining how these two legal systems interact and sometimes conflict in areas such as women’s rights, property rights, and criminal justice.
1.2 Statement of the Problem
While the Nigerian Constitution guarantees fundamental rights to all citizens, customary law in Birnin Kebbi often operates in ways that may contradict these constitutional guarantees, particularly in relation to gender equality and property rights. This study will evaluate how these two legal systems coexist and the challenges that arise in balancing the protections offered by both systems.
1.3 Objectives of the Study
To evaluate the relationship between constitutional law and customary law in Birnin Kebbi LGA.
To assess the impact of customary law on the protection of individual rights as guaranteed by the constitution.
To propose ways to harmonize constitutional and customary law for better legal outcomes in Birnin Kebbi LGA.

The study will focus on the relationship between constitutional and customary law in Birnin Kebbi LGA, Kebbi State. Limitations may include difficulty in accessing specific legal cases or in gaining full cooperation from local traditional institutions.
1.8 Operational Definition of Terms
Customary Law: A body of unwritten laws derived from the traditions, customs, and practices of ethnic groups in Nigeria.
